Class action lawsuit dropped against Coconino County Sheriff and Jail Commander

A class action lawsuit filed by ACLU against Coconino County Sheriff Jim Driscol and Coconino County Jail Commander Matthew Figueroa has been dropped. The suit was filed last December and claimed the Sheriff’s policy of holding pretrial detainees after they have satisfied conditions for release on state charges, was unlawful and violated the Fourth Amendment. In December 2017, Guillermo Tenorio-Serrano was arrested by DPS for extreme DUI. ICE contacted Sheriff Driscol and asked that Tenorio-Serrano be held for an additional 48-hours; they had probable cause that he was a removable alien. A judge reviewing the case ruled in favor of the Sheriff and the jail and the lawsuit was dropped.
